1.By signing this agreement or by utilizing Americable's internet services, you are hereby accepting this agreement and agreeing to abide by its terms and conditions and any amendments. If you do not accept this agreement, you should not utilize these services.
2.The terms and conditions relating to this service may be amended from time to time and will beposted on Americable’s website. If you continue to use this service after new conditions have been posted, it shall constitute acceptance of the terms. If you do not accept the changes, you must terminate the service within 30 days of the notice being posted.
3.Americable will provide one modem or home networking gateway, if home networking service is subscribed to, for an internet connection to your home computer or network device to be installed byAmericable, its contractor, or you. Any equipment provided by Americable to the customer will beconsidered Americable equipment. Any cabling installed by Americable remains the property ofAmericable except as otherwise required by applicable law. Americable will have no obligation toinstall, support, maintain, repair or replace any computer, network interface card, router, cable modem,cabling or other equipment that is not Americable equipment.
4.Customer will not open, alter, misuse, tamper with or remove Americable's equipment. Customer willnot remove any markings or labels from the equipment indicating ownership, serial or identifyingnumbers. Customer will safeguard the equipment from loss or damage of any kind and will not permitanyone other than an authorized representative of the company to perform any work on the equipment(except for any self installation procedures approved by Americable). Upon termination of the service tocustomer, for whatever reason, the customer acknowledges that his/her right to possess and use theequipment shall likewise terminate and the equipment shall be returned to Americable in the samecondition as when received, excepting ordinary wear and tear. Customer will promptly returnequipment or notify Americable to schedule retrieval by Americable. If customer does not return theequipment promptly or schedule retrieval, Americable or its contractor may enter any premises wherethe equipment may be located for the purpose of disconnecting and retrieving the equipment. If theequipment is damaged, destroyed, lost or stolen while in customer's possession, customer shall beliable for the cost of repair or replacement of the equipment. Unreturned modems are $125, power cords$2-$25, & ethernet cords $10.
5.CUSTOMER UNDERSTANDS THAT THE INSTALLATION, USE, INSPECTION, MAINTENANCE,REPAIR, REPLACEMENT OR REMOVAL OF THE SERVICE, AND EQUIPMENT MAY RESULT INDAMAGE TO THE CUSTOMER'S COMPUTER OR OTHER HARDWARE, INCLUDING SOFTWAREAND DATA FILES STORED THEREON. CUSTOMER SHALL BE SOLELY RESPONSIBLE FORBACKING UP ALL EXISTING COMPUTER FILES PRIOR TO THE PERFORMANCE OF ANY OF THEFOREGOING ACTIVITIES. NEITHER AMERICABLE NOR CONTRACTOR SHALL HAVE ANYLIABILITY, AND EACH EXPRESSLY DISCLAIMS ANY RESPONSIBILITY WHATSOEVER FOR ANYDAMAGE TO OR LOSS OR DESTRUCTION OF ANY SOFTWARE, HARDWARE, DATA OR FILES.
6.Customers subscribing to Americable Home Networking Service are subject to this agreement aswell as the “Americable Home Networking Service Policy”. Please refer to the Americable HomeNetworking Service Policy for additional information on Americable Home Networking Service.
7.Subscriber acknowledges and agrees that Americable shall have the right to monitor subscriber'sbandwidth consumption (i.e. aggregate volume of data that may be sent or received) at any time and onan on-going basis, and to limit excessive bandwidth consumption by subscriber (as determined byAmericable) by any means available to Americable, including suspension or termination of internetservice. Americable has determined that excessive bandwidth consumption is considered to be anything exceeding the allowable monthly over usage thresholds per month of aggregate volume of data that has been sent or received by the customer as outlined in paragraph 9.
8.Americable reserves the right to implement specific limits on the maximum amount of bandwidthconsumption available to subscriber per month for the level of service subscribed to by the subscriber. Ifsubscriber exceeds the bandwidth consumption limits assigned to the level of service for whichsubscriber has subscribed in any month, Americable has the right to limit bandwidth consumption bysubscriber in excess of such level by any means available to Americable, including suspension ofservice, and/or to impose additional fees and charges on subscriber. Americable will send a notificationemail regarding usage once the subscriber has reached 50% of their monthly allowable date and againat 75% of their monthly allowable data. Once the subscriber has exceeded the maximum allowable datafor the subscribed package, Americable will send a third email to inform the subscriber that we haveextended the customers limit by 50 Gigabytes for a fee of $12.50. Each successive 50 Gigabyteextension of the limit will also be billed at the rate $12.50 above the allowable per month service offeringas outlined in paragraph 9.

10.THIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUTWARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TOWARRANTIES OF TITLE, NON-INFRINGEMENT OR IMPLIED WARRANTIES OFMERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. AMERICABLE DOES NOTWARRANT THAT THE SERVICE (I.) WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERRORFREE OR (II.) THAT ANY INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE ONTHE SERVICE IS FREE OF VIRUSES, WORMS, TROJAN HORSES OR OTHER HARMFULCOMPONENTS OR (III.) THE SERVICE WILL MEET YOUR REQUIREMENTS. AMERICABLE DOESNOT GUARANTEE THAT YOU WILL BE ABLE TO CONNECT AT YOUR MODEM'S MAXIMUMCONNECTION SPEED DUE TO ANY LIMITATIONS OF SERVICE. NO ADVICE OR INFORMATIONGIVEN BY ACT, ITS AFFILIATES, LICENSEES CONTRACTORS OR THEIR RESPECTIVEEMPLOYEES OR AGENTS SHALL CREATE A WARRANTY.
11.This service is for your personal use only. Customer represents and warrants that he/she is at least18 years of age. The service is provided to the site initially selected by you. You may not transfer theservice to another site without Americable's prior written consent. You agree to use the service for yourpersonal interests and not professional or business, engage in the sale of goods or services or solicitfunds. You agree to publish only personal home pages on Americable's web hosting service. In theevent you violate any of these provisions you may be charged the additional cost you would haveincurred if you had secured an Americable Business account.
12.You may not use any service offered by Americable to provide Internet access to others throughyour connection, host shell accounts, provide email or news services to others.
13.Customer agrees to pay Americable for his/her subscription to the service and for all use applicablecharges for installation and other related fees. Charges for the service are set forth on a separate pricelist and posted on the Americable web site. Postings on the Americable web site may change such charges from time to time. If you do not want to keep the service because of the changes made, you may terminate your service at any time. You shall be obligated for the monthly charge in which the termination becomes effective. All monthly charges are payable one month in advance. In your registration information, you may decide to pay the monthly charges with a credit card and authorize Americable to automatically charge your credit card account each month for monthly charges. If you fail to pay the monthly charges by the due date listed on your bill, Americable will, at its discretion, impose a $10 late fee after the 13th of the month and/or disconnect the service. A $30 reconnect fee will be charged to resume service. Americable will also charge a $30 service fee for all returned checks and bank card or credit card charge backs.
14. Americable will repair, replace equipment or otherwise attempt to correct interruptions of the service, due to reasonable Americable equipment wear and tear or technical malfunctions of the network system operated by Americable, at the company's expense. The customer materials contain details on contacting Americable for support. Americable has no other responsibility for support, maintenance or repair of equipment, software or service, whether provided by the, a third party or the customer. For assistance with other technical problems, if support services are available from Americable, such services will be at additional charge based on an hourly tech support rate. 15.Subscriber may suspend their Internet services while they are on vacation and/or deployment provided they meet ALL of the criteria below:
This document outlines the benefits, service policy and procedures regarding the Americable Home Networking Service itself, its operation and maintenance.
Multiple Connections — Connect up to four computers, or devices like computers, laptops, gaming consoles,
printers, personal digital assistants (PDAs) and more to Americable High-Speed Internet hardwired.
Speed — Speed for the whole household – Americable Home Networking delivers cable-powered 100%
Broadband speed. No dialing or phone line is required for connection.
Wireless Connections — Take the Internet with you from the patio to the kitchen to the family room— all you
need is your laptop and you’re connected.
Security — From the foundation of a built-in Firewall to the additional layers of encryption, our installation
technicians will turn on wireless security for your wireless home network.
Parental Controls — Establish Internet access time limits for computers in your house. Block Web sites that
you do not want users on your home network to access.
File and Printer Sharing — Quickly and easily share files and printers on all computers connected to your
network. We can set it up for you.
Americable Home Networking service will let you connect up to 4 PCs (IP devices) to the Internet at one time
hardwired. Computers using a wireless connection must be within 150 feet of the gateway with minimal
interference. Certain devices using radio frequency (including 2.4GHz cordless phones and microwave ovens),
may interfere with or disrupt Internet connections. Structural interferences in your home can also be a factor in
the range of the wireless network.
Americable Home Networking service is only available to Americable High-Speed Internet customers with any of
the available Internet packages.
Only the Americable issued routing devices are supported for use with the Americable Home Networking
service. Only one Wireless Cable Modem Gateway is available per customer/account.
Customer must demonstrate their PC is functional. (BEFORE SETUP BEGINS ON CUSTOMER EQUIPMENT)
Customer PC/device must have ability to display English for setup. Technician WILL NOT REPAIR PC under
any circumstances. Technician will install only the Americable issued Home Networking equipment, Ethernet
cable, and 4 wireless/wired PCs or devices for the customer.
Printer setup requires customer to have printer documentation showing the network setup of the device before
device will be set up by technician.
Regular Silver, Gold, Platinum, or Diamond service fee charges apply. Americable Wireless Cable Modem
Gateway is required to use the service. Home Networking Service rate is $5.95 per month. If you elect to
have Americable set up your home network for you, an installation fee is required. You will have four PCs or
wireless devices set up for your household. Wireless cards are required in your PC for any wireless connection
to the cable modem gateway.
Equipment provided with installation includes and is limited to the following equipment: Gateway (with
integrated DOCSIS cable modem) and one Ethernet cable to connect one PC. Additional equipment may be
required and is not provided by Americable.
Cable Modem Gateway remains the property of Americable and must be returned to Americable if service is

Customer may elect to receive the Home Networking Service to facilitate the simultaneous, multiple
connections to the service from up to four (4 hardwired) personal computing devices within customer’s single
household. Sharing of the Home Networking Service device with other individuals and their devices is strictly
prohibited. Customer shall be solely responsible for and shall indemnify and hold Americable and its
technicians harmless from and against any and all claims and expenses (including reasonable attorneys’ fees)
arising out of Customer’s use or misuse of the Home Networking Service. Customer acknowledges and
agrees that the Home Networking service may only be used for residential, non-commercial purposes.
Customer further acknowledges that the Home Networking service may still be subject to the security risks
outlined in Section 1.5 of the “User Agreement for Internet Service”, and that the disclaimer of warranty set
forth in Section 6.1 of the “User Agreement for Internet Service” will continue to apply to use of the Home
Networking service. Use of the Home Networking service for commercial purposes is strictly prohibited.

Americable’s new digital service requires Americable provided equipment in order to view the
available television programming. This equipment can only be used by Americable customers at
Americable locations and will not operate at other locations.
AFN programming does not require set top boxes.
Premium channels require a minimum of a subscription to “Digital Basic” service.
Customer has reviewed the equipment available for lease and monthly charges.
Customer will be billed for equipment from date of activation. If customer fails to activate receivers
within 72 hours of receipt, charges will be backdated to date of receipt of equipment.
At company’s discretion, digital equipment may require a deposit.
Cash, Check or Credit/Debit cards are accepted for payment.
In order to terminate service, all Americable provided equipment must be returned to the company
in good condition.
Unreturned or damaged equipment will incur a fee based on Americable’s price list. Set Top Box
(STB) fees as follows:

Service is subject to the terms and conditions of Americable User Agreement provided to customer
